TERMS AND CONDITIONS OF USE

Welcome to TellaTina! Thank you for your patronage of our services. This agreement (“Agreement”) sets out your rights and responsibilities in your use of TellaTina Resources LLP’s mobile application known as “TellaTina” and the services provided through the TellaTina mobile application. By using the App (as defined herein) in any manner whatsoever, you are agreeing to these terms. When this Agreement mentions the terms “we”, “our” or “us”, it refers to TellaTina Resources LLP.

TellaTina is a social network enabling a curated group of people to share contacts, resources, information and engage with the members of the App globally through IOS, Android or other mobile devices. We use “TellaTina” here to refer to our iOS and Android mobile applications (also referred to as the “App”) that provide you with access to that platform.

TellaTina is operated and provided to you by TellaTina Resources LLP, a Limited Liability Partnership incorporated in India, Flat No. 703, Tanna Builders Pvt. Ltd, Raheja Empress, Veer Savarkar Marg, Opposite Siddhi Vinayak Mandir, Prabhadevi, Mumbai- 400025.

Your Account: Each user of the App can only have one account. This account must not be used by others and you must not share your password with others. Please do not use the App if you are under the age of consent to use the services provided by the App in the area that you live.

Accuracy of Information: You must ensure that you provide us with true and accurate information pertaining to your registration as a member or user of the App. Not doing so could be a legal offence. You are responsible for any activities that occur on the App relating to your account. You must notify the Tellatina Resources LLP at support@tellatina.com for any breach of security or unauthorised use of your account

Privacy:Our privacy policy explains how we handle member and user data collected and generated in the course of using the App. Please ensure that you read the privacy policy, since it forms part of this Agreement.

You authorize us to transfer your data to any governmental, statutory or regulatory authority, as described in our privacy policy and as required by law. In such as case, we will ensure that your personal information is protected to the greatest extent possible.

 

All data collected by us and generated in the course of your use of the App shall remain our property. We also reserve the right to share and use in any manner whatsoever the data collected by us and generated in the course of your use of the App with third parties.

Notifications: By using the App, you agree to be subscribed to email messages for information purposes and to notify you of things which may be of your interest. You can change your preferences about receiving messages.

Content on the App: You retain full ownership in all intellectual property rights to the text, photos and videos you submit to TellaTina (collectively, your “Content”). You permit us in the form of a unrestricted,irrevocable royalty free, nonexclusive, worldwide license, to use, copy, and publish your Content based on your settings in the App and the options selected by you when posting and as otherwise described in our privacy policy.

Responsible Posting: We do not monitor Content provided by you. However, please ensure that you do not provide any Content that may be inappropriate, defamatory, illegal, tortious or that otherwise infringes the rights of others. We reserve the right to remove all Content in violation of this requirement, and also reserve the right to suspend, delete or deactivate your account or refuse service to you.

Member Interactions: We bear no responsibility for members’ actions and do not control such actions. Please ensure that you exercise your own discretion when engaging with members. You are advised to be fair and moderate in your comments and not share members’ information without their consent.

We do not interview, run checks on, monitor, supervise, or control TellaTina members. You are responsible for ensuring that you comply with all laws connected with any member interactions. Tellatina is not a party to any transactions between users and members and bears no liability or responsibility for such interations.

License to Use: Your download and installation of the App grants you a limited non-transferable license to personally use the App through your iOS or Android product; additional terms may apply from the site you download it from (Apple App Store or Google Play store) or the manufacturers of your device or software.We reserve the right to charge for use of the App and / or for services provided by us at any point in time. Further, we reserve the right to remove, suspend or delete your account at our discretion.

Feedback: Please feel free to share any feedback, suggestions, or ideas you have about TellaTina with us. You agree that we are free to use any feedback that you voluntarily have provided without restriction and with no obligation to pay or remunerate you.

Support: For any issues, technical or otherwise regarding the usage of the App or our services, you may contact us at support@tellatina.com. We shall try our best to resolve the issues faced by you.

Restrictions from Our Licensors : Some of the information and services available through TellaTina may be licensed from third parties and are covered by the terms and conditions of such third parties:

Limitation of Liability: WE SHALL NOT BE LIABLE FOR ANY LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH TELLATINA, INCLUDING THE TELLATINA APP, OUR SOFTWARE, YOUR USE OF TELLATINA OR ANY TELLATINA SERVICE, OR THIS AGREEMENT. WE AND OUR AFFILIATES SHALL NOT BE LIABLE TO YOU.

Governing Law: This Agreement is governed by laws of India.

Jurisdiction: Any claim or dispute arising from this Agreement or the use of TellaTina will be resolved exclusively by the courts in Mumbai, and we each agree to and submit to the exclusive jurisdiction of the courts in Mumbai in the event of such claims or disputes.

We are not a Party to Disputes between Members: TellaTina is not responsible for the actions of its members. In the event of any dispute between members, you understand that TellaTina Resources LLP is not a party to such dispute in any capacity and is not liable in any manner whatsoever. . You waive any claims against us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Indemnity: You agree to indemnify and hold harmless TellaTina Resources LLP against any claims, including legal costs arising out of misuse by you of the App, any breach of this Agreement or any other form of misconduct or fraud.

Inclusions: This Agreement includes our privacy policy and constitutes the entire agreement between you and us with respect to the App and our services, and supersedes any other agreements or understandings (oral or written). We reserve the right to amend or add to this Agreement at any time by notifying you of the changes (for example, by emailing you, or by posting an amendment notice in your news feed). If you keep using TellaTina after the amendment is effective, you accept and are bound by the new terms; if you disagree with the new terms, you should stop using TellaTina and delete your account.

No Warranty: TELLATINA AND THE ASSOCIATED SOFTWARE AND SERVICES ARE PROVIDED “AS IS.” We do not make any warranties for fitness of the App for any purpose or that any aspect of our software or service will work properly or continuously. We may add, change, or discontinue product features; you may choose to stop using the App if you are not satisfied with its features.We are not responsible for any viruses caused to your device arising from your use of the App or otherwise.

General: This Agreement is on a principal to principal basis and does not create any agency, partnership, joint venture, employment or franchise relationship. The English version of this Agreement is binding and other translations are for convenience only. In case any portion of this Agreement is declared unenforceable, it shall be enforced to the maximum extent possible, and the remaining portions shall be given full effect. Our inaction in a particular circumstance does not waive our right to act with respect to that or other circumstances. We will not be liable for any issues due to a circumstance beyond our reasonable control. You represent and warrant that you are not (i) located in a country that is subject to Indian Government embargo or has been designated by the Indian Government as a “terrorist supporting” country; and (ii) listed on Indian Government list of prohibited or restricted parties.

As a TellaTina user, we encourage you to read this privacy policy (“Privacy Policy”), which sets out our methods of handling personal information, including how and when we use and handle personal information collected and created through your visit to the App (as defined below) owned and operated by by TellaTina resources LLP. By visiting our App you consent to the practices described in this Privacy Policy. When this Privacy Policy mentions the terms “we”, “our” or “us”, it refers to TellaTina Resources LLP. 

Policy Description

This Privacy Policy forms part of the TellaTina Terms & Conditions of Use (“T & Cs”) and it prevails in case of conflicts between the two. By visiting, joining, using the App, or indicating that you agree to this Privacy Policy, you consent to the terms of this Privacy Policy. If you do not consent to us using your information as described hereunder, please stop using the App, including deleting your account, if you have one. Please contact us if you have any questions or concerns.

What we do

TellaTina is a social network enabling a curated group of people to share contacts, resources, information and engage with the members of the App globally through IOS, Android or other mobile devices. We refer to “TellaTina” here as the "App" or as "TellaTina"

Basic Privacy Guidelines

We have set out a few indicative rules to help protect users' personal information and prevent misuse of that information:

• We restrict access to the App, to enable private communication between users and members.
• As a user or member it is your duty to ensure that information or Content (as defined in the T&Cs) shared between members is not disclosed outside of the App without the disclosing member’s permission.
• Don’t share your personal account with someone else.
• Don’t gather information from TellaTina, either manually or using automation (such as through scripts, robots, crawlers or spiders).
• Violating any of the above or other guidelines of the TellaTina T & Cs may lead to a deletion of your account with TellaTina, amongst other appropriate actions.
• All data collected by us and generated in the course of your use of the App shall remain our property. We may share and use in any manner whatsoever the data collected by us and generated in the course of your use of the App with third parties.

Information Collection

TellaTina may collect information from you in the following ways:

• Collection of information from you directly, such as your name, profile photo, email address, and similar information. If you wish to invite new members to join TellaTina, we can send them an invitation and follow-up reminders on your behalf, based on information shared by you.
• You may authorize TellaTina to notify you about its services and availability by sharing your contact information with us.
• TellaTina may collect all content that you create, share or post in audio, video, text, images and other media or software files that you provide on or through the App. We may also collect information that other users provide about you.
• TellaTina may also collect demographic as well geographic location details about you.
• TellaTina may collect technical information generated from your use of TellaTina including:
  • Device information, which includes information such as the type of device you are using, it’s model, operating system and unique device identifier. Your device and software settings affect what information your device makes available to us.
  • Log data, which is automatically recorded by our servers when you use the App. This typically includes the date and time you visited the App version you used (and its settings).
  • Cookie data, arising from “cookies” (small data files stored on your mobile device) and similar technologies. This helps us provide you with better services through recognition and storage of preferences.

We collect information from public sources, such as census data, addresses, property maps, and postal address change information.

This helps us understand our members and potential areas for expansion.

Use of the information collected by us

• We use all the information collected by us to effectively operate the App and also to improve, customize, market and support and provide our services and to better understand users
• We use information collected by us to identify potential new members and invite them in order create a larger community of TellaTina members.
  • If you wish to invite new members to join TellaTina, you may share their email address with us, to enable us to send them invitations and reminders on your behalf.
  • In case a member registers or or logs in via Facebook , we may give such member an option to invite their Facebook friends to TellaTina.
  • We may also use information which is publicly available to identify potential new members and invite them to use TellaTina.
  • We may allow third party ads on TellaTina.
  • We may communicate with you about any new services and features that we may introduce in future and let you know about any changes or updates in the terms and policies of our App and any other important updates.
  • We use information to help you effectively publish Content and view and respond to the Content shared or posted by other members, based on your settings.
  • We use information to understand the demographics of the members registered with TellaTina.
  • We use information to respond to your support requests, diagnose problems and provide resolutions to such problems.
  • We use information for testing and evaluating new products and features to be introduced on TellaTina.

Choices available to the members

• Members have control over what and how they choose to share on TellaTina as they use and communicate through the App.
  • Member’s phone number, profile name and photo, online status, last seen status may be available to other members, although members can configure and change their settings to manage certain information available to other members.
• Choices about invitations and reminders:
  • If you are not a member and not willing to receive invitations or reminders from us, please contact us to opt-out of future email invitations or reminders.
• Choices about how and with whom members share Content:
  • A member can share Content with other TellaTina members, in the form of a private message to another member, or with a Group.
  • Members can edit the Content posted by them or delete it from TellaTina as long their account is active, with the limited exceptions noted below.
    • Private messages to a specific member or members cannot be individually deleted, whether from the members’ side or from the inbox of the recipient(s). (In case of deletion of the account, private messages are deleted along with all other posted Content.)
    • If Content is shared with a group, then it cannot be removed from the group recipients.
    • Please note that deleting a post will result in removal of all replies to that post too.
• If members grant TellaTina, access to geolocation information from their mobile devices, they can revoke that grant at any time by changing the settings on their mobile devices.
• Members can deactivate their account through their account settings, with immediate effect. For reactivation of such accounts, members have to log back in to TellaTina and indicate that they wish to reactivate their account.
  • All email notifications end after account deactivation;
  • Content shared before deactivating will be available to other members.
• Members should contact us at support@tellatina.com to request deletion of their account. ; Deletion of the account may take up to forty (40) days. Once an account is deleted it cannot be undone.
  • Account deletion deletes all of the previously posted Content and all the member specific data except that: (a) private messages may remain visible to the recipient(s) but attributed without member’s identity; and (b) account records may be retained by us to the extent we believe it necessary for any legal, safety, or other legitimate reasons.
  • Because deletion removes the account information from our systems, members may receive fresh invitations to join TellaTina in the future.

Sharing of information with third parties?

• We make the Content shared by you on TellaTina, such as posts, replies, messages, and profile information, available to other TellaTina members based on the preferences in the settings selected by you and as described in this Privacy Policy.
• We avail a few third party services to effectively operate, improve, customize, support, market and provide our service. However, we require these third party service providers to use your information in accordance with our instructions and terms or with your prior permission. These third party service providers are required to use it only to provide their services to us, and are not allowed to use it for their own purposes.
• Legal and Compliance. We may retain, preserve, or share your personal information if we believe that (a) we are legally required to do so in compliance to a request from a governmental, regulatory or judicial authority or (b) that it is in our opinion necessary to protect our rights or property or to enforce our T & Cs or any other policies we have with you.

Other things to understand about your information and TellaTina

• Account Security. TellaTina uses various measures and applies best practices to keep your data secure. However, the virtual and internet related environment is not fully secure and TellaTina cannot guarantee that your personal information will not be improperly accessed. You should ensure that you keep your password safe and not share it with anyone.

• Accessing Your Information. By logging into your account with TellaTina, you can access the information shared by you.

• Other Services. While using TellaTina, you may come across various links to websites and services provided by third parties. If you click on the link and access the third party website or services then the privacy policies of these third parties will apply to your activity. TellaTina is not responsible for such third party service providers’ privacy and security practices.

• Amendment. This Privacy Policy may change from time to time, and it would be prudent to keep visiting this Privacy Policy regularly. If we materially change this Privacy Policy we will send a prior notification of the change. Any access or use of TellaTina after the effective date of any revised Privacy Policy shall be deemed to be consent to the revised Privacy Policy.

• Assignability. All the rights and obligations of TellaTina under this Privacy Policy are assignable by us to any of its affiliates or other third parties without prior notice to the members at its sole discretion.
